Federal Grand Jury in Amarillo Indicts Local Lawyer

AMARILLO, TX—A federal grand jury in Amarillo returned an indictment today charging David Neal Duncan, 38, of Amarillo, with two counts of carrying a weapon on an aircraft, announced acting U.S. Attorney James T. Jacks of the Northern District of Texas. It is anticipated that Duncan will surrender to federal authorities within the week for his initial appearance.

The indictment alleges that on two occasions, November 29, 2007 and February 6, 2009, Duncan attempted to board an aircraft with a concealed loaded Glock semi-automatic pistol. He was stopped at the x-ray screeners both times when he attempted to go through security. Each time he had a different loaded pistol.

An indictment is an accusation by a federal grand jury and a defendant is entitled to the presumption of innocence unless proven guilty. Upon conviction, however, each count carries a maximum statutory sentence of 10 years in prison and a $250,000 fine.

The case was investigated by the FBI and is being prosecuted by Assistant U.S. Attorney Christy Drake of the Amarillo, Texas, U.S. Attorney’s Office.
